Abstract

This paper deals with the right of insurance carriers incurred by compensating the insured party for any loss. This is Subrogation, which describes a right held by most insurance carriers to legally pursue a third party that caused an insurance loss to the insured. In this paper, the researcher elaborates on legal value, scope, conditions and exceptions of subrogation in both Islamic jurisprudence and man-made law in Egypt and the United Arab Emirates, either in commercial insurance or Islamic insurance.
