The Significance of “La Ba’s” (No Objection) in Juristic Instruction

The research aims to clarify the position of the Jurists on the significance of the expression “no objection” and its impact on the jurisprudential branches through the etymology of the legal term. Its usage in the Prophet’s Sunnah has been authenticated. As well, this term was frequently used by the Companions, their successors and jurists in their legal opinions. Hence, the researcher seeks to demonstrate how such terms and their meanings bear the differences among jurists on them, mainly when quoting the legal opinions on such various purports. As a detailed model, this paper deals with “no objection”, titled: the Significance of “No Objection” in Juristic Instruction. It is divided into an introduction, a preface, four sections, and a conclusion. This paper aims to connect original legal cases to new ones; since regulating the implication of a term affect the way of deducing legal rulings. This is clearly reflected by highlighting the term’s true significance, etymology, jurists’ views on it and its relation to legal rulings.
